Kukunin Platform provides the following cloud-based services:

• Own Cloud Hosting: Managed cloud infrastructure for hosting applications and data.
• Cloud Kubernetes: Managed Kubernetes clusters for container orchestration.
• OpenClaw AI Agents: AI agent platform for building and deploying intelligent automation.

Services are provided on a subscription basis. Specific features, limitations, and pricing are detailed in your service agreement or on our website.

3. Account Registration

To use our services, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be at least 18 years old or the age of majority in your jurisdiction

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Engage in unauthorized access to systems or data
• Send spam or unsolicited communications
• Interfere with or disrupt our services or infrastructure
• Host or distribute illegal content
• Engage in cryptocurrency mining without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

5. Payment Terms

• Billing: Services are billed on a subscription basis (monthly or annually) or usage-based, as specified in your plan.
• Payment: Payment is due at the beginning of each billing period. We accept major credit cards through our payment processor, Stripe.
• Taxes: You are responsible for all applicable taxes. Prices do not include taxes unless stated otherwise.
• Late Payment: Accounts with overdue payments may be suspended until payment is received.
• Price Changes: We may change prices with 30 days notice. Continued use after price changes constitutes acceptance.

6. Service Level Agreement

We strive to provide reliable services with high availability. Our standard service level includes:

• 99.9% uptime target for production services
• 24/7 infrastructure monitoring
• Regular backups (frequency depends on plan)
• Security updates and patches

Enterprise customers may negotiate custom SLAs with specific uptime guarantees and service credits.

7. Data and Content

• Your Data: You retain ownership of all data you upload to our services. You grant us a limited license to host and process your data to provide the services.
• Backups: While we maintain backups, you are responsible for maintaining your own backup copies of critical data.
• Data Export: You may export your data at any time during your subscription.
• Data Deletion: Upon account termination, we will delete your data within 90 days unless retention is required by law.

8. Intellectual Property

Kukunin Platform and its services, including all software, documentation, and branding, are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use our services as described herein.

9. Termination

• By You: You may cancel your subscription at any time through your account settings or by contacting us.
• By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or for any reason with 30 days notice.
• Effect: Upon termination, your access to services will end. You may export your data before termination.

10. Disclaimer of Warranties

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUKUNIN PLATFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Kukunin Platform from any claims, damages, or expenses arising from your use of the services, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of services after changes constitutes acceptance of the modified Terms.
